Grandparents' Rights: Visitation and Custody
Most people have wonderful memories of spending time with their grandparents. Grandparents add fun and value to their grandchildren’s lives and provide sources of support outside the realm of the child’s parents. This bond can be essential and meaningful for both grandparents and grandchildren. More often than not, a divorce will not impact the relationship between the grandparent and their grandchildren, but if it does, grandparents may sue for visitation rights or custody of the child.
The United States Supreme Court determined that grandparents do not have a constitutional right to their grandchildren because it is the parents’ right.
