During a child’s early years (up to age 9 for boys and 11 for girls), they are generally expected to be cared for by their mothers and women of the community. If Muslim parents divorce while the children are still at this age, custody typically remains with the mother. Once boys reach age 9, they must live with their father. Girls may choose to stay with their mother.
2. Spiritual Guardianship
Fathers are typically tasked with their children’s spiritual upbringing, ensuring they are raised as devout Muslims. This role can also be assigned to other male relatives on the father’s side.
3. Property Guardianship
Fathers may also be given guardianship over their children’s property. This can come with broader legal responsibilities, such as decision-making authority regarding the child’s well-being.
In the United States, divorce law does not always align with Islamic law. For instance, both men and women can initiate divorce in Texas, and parents typically share child custody unless there are extreme circumstances.
